PRESIDENT OBAMA ANNOUNCES NEW EXECUTIVE ACTION INITIATIVES

On November 20, 2014, the President announced new executive actions to be implemented by the USCIS. These actions include (1) the creation of a new "Deferred Action for Parental Accountability" (DAPA) Program for certain individuals who have US citizen and/or green card children, and who came to the United States more than 5 years ago; (2) the expansion of the eligibility criteria for the existing Deferred Action for Childhood Arrivals (DACA) Program created by the President in 2012; and (3) the expansion of eligible Applicants for the Provisional Unlawful Presence (ULP) Waiver Program, announced in 2013.

New Deferred Action for Parental Accountability (DAPA) Program

Under the new DAPA Program, you are eligible if ALL of the following apply to you:
  • Are the parent of a U.S. citizen or lawful permanent resident born on or before November 20, 2014;
  • Have continuously resided in the United States from January 1, 2010 until the present time; and
  • Have not been convicted of a felony, significant misdemeanor, or three or more other misdemeanors, and do not otherwise pose a threat to national security or public safety.
Expanded Deferred Action for Childhood Arrivals (DACA) Program

Under the new, expanded DACA Program, you are eligible if ALL of the following apply to you:
  • Are currently 15 years old or older (unless you are currently in removal proceedings and/or have a final order of removal; in that case, you may be under 15 years of age);
  • Came to the United States before reaching the age of 16;
  • Have continuously resided in the United States from January 1, 2010 until the present time;
  • Are currently in school, have graduated or obtained a certificate of completion from high school, have obtained a general education development (GED) certificate, or are an honorably discharged veteran of the Coast Guard or Armed Forces of the United States; and
  • Have not been convicted of a felony, significant misdemeanor, or three or more other misdemeanors, and do not otherwise pose a threat to national security or public safety.
Expanded Provisional Unlawful Presence Waiver (ULP) Program

Under the new eligibility criteria for the ULP Waiver Program, the following individuals are now eligible to apply for an Provisional Unlawful Presence Waiver:
  • Spouses and minor children of U.S. citizens;
  • Sons and daughters of U.S. citizens (*NEW*); and
  • Spouse and sons or daughters of lawful permanent residents (*NEW*).
Eligible individuals granted Deferred Action under either of the two Deferred Action Programs will not be subject to removal from the United States while under Deferred Action, and are granted an Employment Authorization Document allowing them to work legally in the United States.
